Constitutional Status & Effective Control

This research branch examines the constitutional status of the Mainland Area, the legal significance of the ROC government’s loss of effective control after 1949, and the consequences of long-term de facto administration.

No status theory is predetermined. Constitutional displacement, competing-government, succession, de facto-government, civil-war and occupation-related theories must each be tested against controlling ROC authority, historical evidence, international law and serious contrary arguments.

The branch links directly to FCLR Constitutional Opinion 2026-1 and preserves separate analysis of constitutional title, governmental effectiveness, international recognition, public acts and private-rights continuity.
