ROC Judicial Engagement with Mainland China

This branch catalogs and analyzes how courts and constitutional institutions of the Republic of China in Taiwan have addressed Mainland Area persons, cross-Strait legal relations, territory, status, rights, judgments, family relations, property, criminal jurisdiction and recognition of legal acts.

Research must distinguish actual holdings from dicta, procedural dismissals from merits decisions, and constitutional interpretation from political-question determinations. Non-response or lack of jurisdiction does not constitute approval of an FCM position.

Current research includes J.Y. Interpretations and Constitutional Court decisions concerning territorial questions, Mainland Area persons, equality, due process and the statutory framework enacted under the Additional Articles, with exact citations and scope to be verified before publication.
