    Le Free China Movement appelle à la transparence et aux garanties de procédure lors de l’entrée en vigueur des nouvelles règles d’entrée-sortie en Chine continentale

    Le décret n° 841 entre en vigueur le 15 septembre ; le FCM demande la publication des règles d’application, un contrôle juridictionnel et des garanties contre les restrictions arbitraires ou politiquement motivées à la liberté de circulation.

    WASHINGTON, D.C., 5 septembre 2026 — Le Free China Movement (FCM) appelle le régime communiste de Chine continentale à garantir que les règles révisées d’entrée et de sortie prévues par le décret n° 841 du Conseil des affaires d’État soient appliquées de manière transparente et ne servent pas à élargir arbitrairement les restrictions imposées aux citoyens de Chine continentale souhaitant quitter leur pays et y revenir.

    La liberté de circulation est un droit humain fondamental. Aucun citoyen de Chine continentale ne devrait perdre la possibilité de voyager à l’étranger en raison d’une liste noire non publiée, d’une décision administrative inexpliquée, d’une activité politique ou religieuse, d’une critique pacifique du gouvernement ou de pressions exercées sur sa famille.

    L’examen du décret n° 841 par le FCM souligne également l’importance de l’exactitude factuelle. Le règlement national publié n’instaure pas, à lui seul, une nouvelle obligation universelle imposant à tous les étudiants, médecins, employés d’université ou travailleurs du secteur privé d’obtenir l’autorisation de leur employeur avant de quitter la Chine continentale.

    Des systèmes existants de conservation des passeports et d’autorisation préalable des déplacements s’appliquent toutefois à diverses catégories de personnels du Parti, de l’État, d’institutions publiques, d’entreprises d’État et à d’autres personnels désignés ; certaines institutions peuvent aussi imposer des exigences internes supplémentaires. Cette distinction rend la transparence d’autant plus nécessaire.

    Le FCM demande six garanties fondamentales

    • Publication des règles d’application et des catégories de personnes soumises à des contrôles particuliers de sortie.
    • Motifs écrits chaque fois qu’un passeport est retenu ou qu’une sortie du territoire est refusée.
    • Contrôle juridictionnel indépendant et recours effectif pour toute personne soumise à une restriction.
    • Fin des interdictions de sortie à motivation politique visant l’activité politique pacifique, la religion, le journalisme, la défense juridique ou la critique du gouvernement.
    • Aucune punition collective contre les membres de la famille.
    • Responsabilité publique par la publication annuelle du nombre de restrictions et de leurs fondements juridiques.

    La liberté de circulation ne doit pas dépendre de la loyauté politique

    Un gouvernement moderne ne devrait pas craindre la libre circulation de ses propres citoyens.

    La Chine continentale appartient à son peuple — et non au Parti communiste chinois, à ses services de sécurité ou à un dirigeant individuel.

    Le droit de quitter son pays et d’y revenir doit être protégé par la loi, et non dépendre de la loyauté politique ou du pouvoir discrétionnaire administratif.

    Le Free China Movement surveillera la mise en œuvre du décret n° 841 après le 15 septembre et documentera les éléments crédibles montrant des restrictions arbitraires ou politiquement motivées touchant des citoyens de Chine continentale.

    Le FCM appelle également les gouvernements démocratiques, les organisations internationales de défense des droits humains, les journalistes et les chercheurs à distinguer soigneusement les restrictions figurant dans le règlement national publié des pratiques séparées de contrôle des passeports ou d’autorisation de déplacement imposées par certains organismes, institutions ou employeurs.

    華盛頓特區,2026年9月5日 — 自由中國運動(FCM)呼籲中國大陸中共政權確保國務院第841號令下修訂的出入境規定得到透明實施,不得藉此擴大對中國大陸公民離開並返回自己國家的任意限制。

    遷徙自由是一項基本人權。任何中國大陸公民都不應因未公開的黑名單、無解釋的行政決定、政治或宗教活動、和平批評政府,或針對家屬的壓力而失去出國旅行的能力。

    FCM對第841號令的審閱也顯示,事實準確性至關重要。已公布的規章本身並未建立一項新的普遍要求,規定所有學生、醫生、大學僱員或私營部門工作者在離開中國大陸前都必須取得雇主許可。

    然而,既有的護照集中保管和出行審批制度已適用於各類黨政機關、公共機構、國有企業及其他被指定人員,個別機構也可能施加額外內部要求。正因如此,透明度更加重要。

    FCM呼籲六項基本保障

    • 公布實施規則:公開所有實施規定、適用標準及受特殊出境控制的人員類別。
    • 書面說明限制理由:扣留護照或拒絕離境時,應向當事人提供列明具體法律依據的書面通知。
    • 獨立司法審查:受到出境限制者應能獲得有實質意義的申訴與獨立司法審查。
    • 停止政治性出境禁令:不得以和平政治活動、宗教信仰、新聞工作、法律倡議或批評政府為由施加出境限制。
    • 不得連坐:不得因另一人的政治或公民活動而限制其家屬旅行或採取其他脅迫措施。
    • 公開問責:當局應每年公布出境限制數量及其法律依據。

    遷徙自由不應取決於政治忠誠

    一個現代政府不應害怕本國公民自由流動。

    中國大陸屬於人民,而不屬於中國共產黨、其安全機構或任何個人統治者。

    離開自己的國家並返回的權利應由法律保障,而不應取決於政治忠誠或行政裁量。

    自由中國運動將在9月15日之後監察第841號令的實施,記錄影響中國大陸公民的可信任意或政治動機限制證據。

    FCM亦呼籲民主政府、國際人權組織、記者及研究人員監察新規實施,並仔細區分已公布國家規章所載限制與個別政府機關、機構或雇主另行施加的護照管制或出行審批做法。

    华盛顿特区,2026年9月5日 — 自由中国运动(FCM)呼吁大陆中共政权确保国务院第841号令项下修订后的出境入境规定得到透明实施,不得借此扩大对大陆中国公民离开和返回自己国家权利的任意限制。

    迁徙自由是一项基本人权。任何大陆中国公民都不应因未公开的黑名单、无法解释的行政决定、政治或宗教活动、和平批评政府,或针对家属施加的压力而失去出境旅行的能力。

    FCM对第841号令的审阅同时强调事实准确性。已经公布的法规本身并未规定所有学生、医生、大学雇员或私营企业员工在离开大陆中国前都必须获得雇主批准。既有的护照集中保管和出境审批制度适用于部分党政机关、事业单位、国有企业及其他指定人员,一些机构还可能实行额外内部要求。

    FCM呼吁六项基本保障

    Order No. 841 takes effect September 15; FCM calls for published implementation rules, judicial review, and safeguards against arbitrary or politically motivated restrictions on freedom of movement.

    WASHINGTON, D.C., September 5, 2026 — The Free China Movement (FCM) calls on the Mainland Chinese Communist Government to ensure that revised exit-entry regulations under State Council Order No. 841, scheduled to take effect September 15, are implemented transparently and are not used to expand arbitrary restrictions on the freedom of Mainland Chinese citizens to leave and return to their own country.

    Freedom of movement is a fundamental human right. No Mainland Chinese citizen should lose the ability to travel abroad because of an unpublished blacklist, an unexplained administrative decision, political or religious activity, peaceful criticism of the government, or pressure imposed on family members.

    FCM’s review of Order No. 841 also underscores the importance of factual accuracy. The published regulation does not itself establish a universal new requirement that all students, doctors, university employees or private-sector workers obtain employer permission before leaving Mainland China.

    Existing passport-custody and travel-approval systems, however, already apply to various categories of Communist Party, state, public-institution, state-owned-enterprise and other designated personnel, while individual institutions may impose additional internal requirements.

    That distinction makes transparency even more important.

    FCM Calls for Six Basic Safeguards

    • Publication of implementing rules — All implementing regulations, eligibility standards and categories of persons subject to special exit controls should be publicly available.
    • Written reasons for restrictions — Whenever a passport is withheld or permission to leave Mainland China is denied, the affected person should receive written notice identifying the specific legal basis.
    • Independent judicial review — Every person subjected to an exit restriction should have access to meaningful appeal and independent judicial review.
    • An end to political exit bans — Exit restrictions must not be imposed as punishment for peaceful political activity, religious belief, journalism, legal advocacy or criticism of the government.
    • No collective punishment — Family members must not be subjected to travel restrictions or other coercive measures because of another person’s political or civic activities.
    • Public accountability — Authorities should publish annual statistics identifying the number of exit restrictions imposed and their legal grounds.

    Freedom of Movement Should Not Depend on Political Loyalty

    A modern government should not fear the free movement of its own citizens.

    Mainland China belongs to its people—not to the Chinese Communist Party, its security agencies, or any individual ruler.

    The right to leave one’s country and return to it should be protected by law, not dependent upon political loyalty or administrative discretion.

    The Free China Movement will monitor implementation of Order No. 841 after September 15 and document credible evidence of arbitrary or politically motivated restrictions affecting Mainland Chinese citizens.

    FCM also calls on democratic governments, international human-rights organizations, journalists and researchers to monitor implementation of the new regulations and distinguish carefully between restrictions contained in the published national regulation and separate passport-control or travel-approval practices imposed by particular government bodies, institutions or employers.

    Mainland Chinese legal authorities have long stated that a 9 a.m.–9 p.m., six-days-a-week “996” schedule can violate statutory overtime limits. But excessive or unlawful overtime is not automatically forced labour under international standards. Forced labour requires work extracted under menace of penalty and without genuine voluntariness.

    The European Union’s Forced Labour Regulation creates a product-based prohibition on goods made with forced labour and will become fully applicable in December 2027. Its enforcement turns on evidence linking forced labour to products and supply chains. It is not a general EU complaint channel for every unlawful overtime dispute.

    Worker protection requires both accurate legal categories and effective enforcement. Mainland authorities should enforce overtime limits, protect workers from retaliation and allow independent reporting of abuses. Companies and importers should examine coercion, recruitment fees, document retention, threats, wage withholding and inability to leave—not merely hours worked—when assessing forced-labour risk. The EU should publish clear evidentiary standards and enforcement outcomes as its product-ban regime begins.
