Policy question

China’s Regulation on Guaranteeing Payment of Wages to Migrant Workers took effect on May 1, 2020. Its central principle is valuable: migrant workers have the right to be paid fully and on time, and governments and employers have defined responsibilities for preventing and resolving arrears. The governance issue is whether those legal rights become fast, reliable payment in practice.

What the policy gets right

FCM supports the regulation’s core objective. Wage theft and chronic arrears can destabilize household finances, disrupt children’s schooling, increase debt and push workers into desperate protest. Assigning responsibility to local governments, employers and construction/project chains is an important foundation.

What the evidence shows

The existence of a legal right does not prove effective implementation. China Labour Bulletin’s 2024–2025 monitoring continued to record many wage-arrears and social-insurance disputes, with unpaid wages repeatedly appearing as a major cause of worker action and calls for help. These data are not a representative national survey and should not be used to claim a national incidence rate; they are evidence of a persistent enforcement problem requiring policy attention.

No contemporaneous FCM position on the 2020 regulation has yet been verified. The following recommendations are a current governance proposal and are not backdated.

FCM governing alternative

A Third Republic labor-protection system should create a national digital wage-claim clearinghouse; require traceable payroll records; use wage escrow or payment bonds in high-risk construction and subcontracting sectors; impose appropriate joint liability through contractor chains; allow rapid provisional payment orders within 15–30 days subject to judicial appeal; add automatic interest and penalties for unjustified arrears; give unpaid wages priority in insolvency; make social-insurance accounts nationally portable; protect whistleblowers and worker representatives from retaliation; and strengthen independent labor inspection and genuine collective bargaining.

How to measure success

Publish median days from wage claim to payment; amount recovered; repeat-offender rates; arrears complaints per 100,000 workers; social-insurance contribution gaps; construction escrow compliance; retaliation complaints; bankruptcy recovery rates; and disputes resolved before workers resort to collective protest.
